Assisted reproduction in surrogacy agreements
Assisted reproduction is not allowed in surrogacy agreements.
Healthcare professionals are prohibited from providing assisted reproduction if a surrogacy agreement exists, regardless of whether it is an altruistic or commercial surrogacy agreement.
A surrogacy agreement involves an individual able to conceive (the surrogate mother) agreeing to carry and give birth to a child who will then be handed over to the intended parent(s)—a couple or a single individual.
In a commercial surrogacy arrangement, the surrogate is compensated by the intended parent(s) for carrying the pregnancy. By contrast, an altruistic surrogacy arrangement involves no financial exchange related to the agreement.
