Parentage registration as a transgender individual

If you are a transgender individual and you have changed legal gender before the birth of the child, you will be registered as the parent of the child based on the gender you are now registered with in CPR.

However, during a paternity or co-parenting case, your rights and obligations remain based on the gender you were assigned before your legal gender transition.

This means that parties in cases of paternity and co-maternity who have undergone legal gender reassignment before the birth of the child have the same rights and obligations in relation to the child as they would have had according to their gender before the legal gender reassignment. Apart from the parental designation, the rights and obligations of the parties in relation to the child remain unchanged.

If you have completed a legal gender transition to male and give birth to a child, you will be covered by the birth parent's obligation to disclose who is or may be the child's other parent, and you will have a birth parent's right and obligation to parental leave under the Maternity Leave Act. But you will be considered the father of the child.
