Can we have a case of access processed, and who can apply for residence?
Get guidance on cases concerning access and residence. You can use the Family Law Centre's open offer before you send an application.
- If you disagree about your child's place of residence, you can file a case about it at the House of Family Law.
- If you cannot agree at a meeting at the Family Law Centre, the Family Law Centre can, once the case has been announced, send your case to the Family Court, which will issue a judgement on where your child should live.
- Only persons with shared custody have the opportunity to apply for residence for the child.
