Can we have a case of ac­cess pro­ces­sed, and who can ap­ply for resi­den­ce?

Get guidance on cases concerning access and residence. You can use the Family Law Centre's open offer before you send an application.

  • If you disagree about your child's place of residence, you can file a case about it at the House of Family Law.
  • If you cannot agree at a meeting at the Family Law Centre, the Family Law Centre can, once the case has been announced, send your case to the Family Court, which will issue a judgement on where your child should live.
  • Only persons with shared custody have the opportunity to apply for residence for the child.
